A family is suing Apple after their son’s eardrum burst while he was wearing Airpods during an Amber Alert.

The twelve-year-old boy has reportedly permanently lost his hearing as a result of the incident.
According to TMZ, Carlos Gordoa and Ariani Reyes filed a lawsuit against Apple on Monday for the incident which happened back in 2020.
In the legal documents, obtained by TMZ, Gordoa and Reyes claimed that back in May 2020, their son was wearing Airpods and watching Netflix on his phone when an Amber Alert went off.
NBC News reports that despite boy watching Netflix on a “low volume,” when the Amber Alert went off the volume turned up.
The outlet reports that the lawsuit stated the alert “went off suddenly, and without warning, at a volume that tore apart B.G.’s ear drum, damaged his cochlea, and caused significant injuries to B.G.’s hearing.”
As a result, the family claim that their son’s life has been “‘severely altered” and that he must now wear a hearing aid, TMZ reports.
The boy was also said to suffer from dizziness and tinnitus following the incident.
The outlet reports that the lawsuit accuses Apple of “negligence” and “fraud.”
It also claimed that Apple was aware of the problem that alerts changed the volume on Airpod’s as there are reportedly complaints online.
The complaints are said to date back to 2019.
