The family of a man whose body fell out of his casket is suing the funeral home for negligence and emotional distress…

A family from Massachusetts filed a lawsuit against the Perez Funeral Home last Wednesday…

After their loved one’s body fell out of a casket while it was being lowered into the grave.

The funeral was being held by the family of Andrew Serrano, who died in March 2019.

When it came to his body being lowered into the ground, the casket door flew open, leaving family and friends “horrified” at the sight in front of them.

As reported by The Eagle-Tribune via multiple news outlets…

The lawsuit stated: “one of the side straps on the city-owned casket lowering device broke, causing Mr. Serrano’s casket to fall into the grave and break apart.”

According to the report, the family are suing on 9 counts of “negligent and reckless infliction of emotional distress.”

The lawsuit revealed that the body “fell out of the casket and into the grave,” where it could be seen “oozing fluid,” which was witnessed by his family “who became visibly distraught and hysterical,” the newspaper added.

Some family members jumped into the grave and managed to lift the body out…

After which the body of Serrano was taken back to the funeral home and was re-buried a few days later.

The family has made a request for $50,001 in damages from Bellevue Cemetery, where the devastating incident took place.
