Kristin Smart’s family sues college for ‘failing to protect her from killer’

Paul Flores, a fellow student, was the last to be seen with the intoxicated Kristin. He had offered to escort her back to her dormitory. Kristin was never seen again after that night.

The Unfolding Investigation

Cal Poly didn’t rush to investigate Kristin’s disappearance. 

In fact, they assumed she had taken an impromptu vacation for the Memorial Day weekend, without informing her folks.

“They believed she went on a vacation for Memorial Day weekend without telling her parents.”

This assumption delayed the official missing report by a week, leading to potential crucial evidence being lost.

The Role of Paul Flores

As the last person seen with Kristin, Paul Flores was the prime suspect. 

However, even after being questioned by detectives and sporting a suspicious black eye, Flores was released without any charges. 

In a shocking twist, it took a staggering 25 years to finally arrest him.

Conviction and Apology

In 2022, Flores was found guilty of Kristin Smart’s murder and sentenced to 25 years to life in prison. 

A year later, Cal Poly issued an official public apology to the Smart family, acknowledging the mishandling of the investigation.

The Lawsuit Against Cal Poly

In the aftermath of the apology, the Smart family decided to sue Cal Poly for negligence, wrongful death, and emotional distress. 

They claimed that the University’s failure to act promptly and effectively had directly contributed to Kristin’s death.

Missing Reports

The lawsuit alleged that Cal Poly ignored crucial reports from multiple students who had reported Flores for harassment and stalking before Kristin’s disappearance.

The family claimed that the university allowed Flores’s room to be cleaned and sanitized even before it was searched, a grave oversight in any criminal investigation.

They believe that the university was in the best position to prevent Kristin’s untimely death and hold them responsible for their failures.
